Attorney General Kihara Kariuki yesterday denied claims that members of the National Security Advisory Committee (NSAC) tried to prevail upon the electoral commission’s chairman Wafula Chebukati to alter the results of the presidential election.

Through his lawyer George Oraro, the AG told Supreme Court that the team only met Chebukati to discuss the security situation in the country following the delay in the announcement of the election results.

In his submission before the seven-judge bench, Oraro argued that tension was building up in the country following the delays in the declaration of the presidential results and there was a need for the team to meet to deliberate on the matter.

Oraro told the court to disregard the claims by Chebukati that they asked him to change the final results saying there was no evidence to back his claims.

“The visit to IEBC was instigated as a result of the activities at the tallying centre following the suspension of the transmission of the results without an explanation from IEBC,” said Oraro.

Security issues

He added: “These NSAC officials are Kenyans of high integrity, high professionals who have climbed the ladder and it would be wrong for their names to be drawn into politics. In fact, these people were merely asked to see Chebukai to discuss security issues and not by any chance to alter results.”

 Oraro told the court that contrary to claims that commissioner Abdi Guliye informed Chebukati of the presence of the NSAC officials, he had already been called by Head of Public Service Joseph Kinyua informing him that a team of security officers was on its way to meet him to discuss security issues.

 Oraro stated that at no time did the team, led by Principal Administrative Secretary in the office of President Kennedy Kihara, and included of Solicitor General Kennedy Ogeto, Inspector General of Police Hillary Mutyambai and LT. General Francis Omondi Ogolla, the Vice Chief of Defense, have any intention of discussing the outcome of the election.
