The Attorney General Justin Muturi has urged the Supreme Court to strike out three appeals challenging the mandatory deduction of the new National Social Security Fund (NSSF) monthly fee.


Muturi through lawyers Fred Ngatia and Mmene Eredi asked the seven judges of the apex court led by Chief Justice Martha Koome to uphold the Court of Appeal decision that declared that the NSSF Act No. 45 of 2013 constitutional and allow the government to continue enforcing the same.


The AG defended the government decision to enhance the NSSF saying the new deducted savings increase Kenyan’s wealth index globally. “Before this Act we had a repealed Act that had a ceiling of contributions of Sh200 per month from the employee and under a similar amount from the employer and l inform you the Chief Justice (Koome) that this persisted since 1965. In 1965 it was less than Sh40, the last 10 years it was Sh200.

In our affidavit we have shown this syndrome of this age of poverty at the end of 30 years the savings that one would have done is Sh144,000 after a light time of struggle the only saving would be Sh144,000 plus the accrued interest that very unfair,” Ngatia told the Supreme court judges.


He added Kenya used to have the highest incidences of old age poverty. This has now come to an end because of the very innovative and transformative NSSF Act.
