Mboya’s family denies coercion in case withdrawal
The family of Cynthia Mboya, a 26-year-old student at the University of Nairobi who fell from the second floor of an apartment in Kasarani, has denied claims that she was forced to withdraw her case.
Mboya’s brother, who chose to remain anonymous, stated that his sister accidentally fell while drinking and was not pushed off the balcony as had earlier been reported. He refuted reports that she was taken from her hospital bed to withdraw her case at the police station.
It had initially reported that Mboya had gone to visit her boyfriend and found another woman’s items, which angered her leading to a scuffle that resulted to the incident.
However, according to her brother, Mboya told him that she was intoxicated that night and had accidentally fallen off the balcony of Q Apartment while drinking with her boyfriend.
“When I went to the hospital where my sister was rushed, I found her. Later when she became sober, she told me that she accidentally fell off the balcony to the ground floor of Q Apartment while drinking with her boyfriend that night injuring herself,” he said.
He also dismissed reports that his sister was taken out of her hospital bed at a Catholic Mission health facility where she was being treated and driven to Kasarani Police Station to withdraw her case.
After being rushed to the hospital, Mboya was discharged the following day with strained muscles, and doctors confirmed that her injuries were not severe.
“The neighboura rushed her to Uhai Neema by the neighbours where she received prompt medical attention and we later transferred her to German Medical Centre for further evaluation, including an MRI scan. Fortunately, the doctors confirmed that her injuries were not severe and diagnosed her with strained muscles, which should fully recover within a few days,” the brother stated.
In her earlier statement with the police, Mboya confirmed that she gone to the apartment to visit her boyfriend (Kiptoo) who was then with a male friend.
An amateur video seen by People Daily shows members of the public interrogating Mboya as she narrates what actually transpired. Mboya, who was captured writhing in pain, told the neighbors who responded to her distress call that she visited her boyfriend and found some items belonging to another woman, which infuriated her.
She later withdrew her complaint, stating that she was not seriously injured and did not wish to pursue the case any further.
The suspects in the case, Mboya’s boyfriend and his cousin, were released after she withdrew the complaint, but detectives stated that the matter was still under investigation and the suspects would be reporting to the police.
The Kasarani police further issued the two with a notice compelling attendance at the police station next Friday, commonly referred to as P52.
