Kiambu Deputy Governor James Nyoro wants the High Court to declare some sections of the County Governments Act unconstitutional arguing they are denying him a chance to execute his duties effectively.

In a cross-petition filed yesterday, Nyoro through lawyer Kibe Mungai, said he should be allowed to exercise such powers as may be necessary, for the execution of the office of governor during the  period he will be serving as the acting governor of Kiambu County.

Nyoro said in response to a petition filed by a Kiambu resident Bernard Chege that by dint of Article 259(3)(a) and (b) of the Constitution, so long as he remains the acting Governor, the law permits him to perform all the functions and exercise all the powers conferred by the Constitution on the office of the governor.

Nyoro said that currently, the County Public Service Board (CPSB) of Kiambu is not fully constituted and therefore lacks quorum to discharge its mandate.

In the petition,  Chege moved to court to challenge the powers of the deputy governor, to reshuffle the county executive committee members saying it is a recipe for chaos because Governor Ferdinand Waititu likely to revise it.
