You’ve case to answer in DP murder claim, Itumbi told

A Nairobi court yesterday ruled that former State House Digital Director Dennis Itumbi has a case to answer in connection with alleged assassination plot against Deputy President William Ruto. 

Milimani Chief Magistrate Martha Mutuku put Itumbi and his co-accused blogger, Samuel Gateri on their defence after the prosecution established a prima facie case against them. 

 “After analysing evidence on record, I find that the prosecution has proved beyond reasonable doubt charges against the accused persons herein.

I accordingly put them on their defence,” Mutuku ruled. Itumbi faces three charges of reprogramming a phone, making and publishing false documents.

In the case, the Prosecution, through Anderson Gikunda called eight witnesses to prove the charges against Itumbi and Gateri.

However, Itumbi, through his lawyer Katwa Kigen, had urged the court to acquit him of all the charges for lack of evidence.

“That the prosecution has not made out a case, which the court can be interested in his (Itumbi) defence,” said Kigen.

He argued that the charge of making a false document under Section 66 of the Penal Code is unconstitutional following the High Court decision in the case of blogger Cyprian Nyakundi this year.
