Woman in company of ailing senator detained for a week

A teacher linked to an incident in which Machakos Senator Boniface Mutinda Kabaka collapsed before being admitted to Nairobi Hospital may face serious charges, a Nairobi court was told yesterday.
At the same time, Milimani Senior Resident Magistrate David Ndungi allowed detectives seven more days to continue detaining Esther Nthenya Muli, to complete investigations into the incident which occurred in Kilimani, Nairobi on Thursday.
According to the prosecution, Kabaka is still unconscious at the hospital’s ICU where he was rushed after he fell sick.
The prosecution told the court that senator Kabaka had driven himself to 3Dee Apartments on Thursday in Kilimani, along Elgeyo Marakwet road Nairobi in the afternoon, booked a room where the suspect joined him at around 3pm.
The court heard that the records show that he looked well before the incident that was preceded with a bout of vomiting.
The magistrate concurred with the police that “it is necessary to detain the woman who was with the politician at 3Dee Apartments for a while to see if the Senator will improve.”
Kabaka was rushed by an ambulance to Nairobi Hospital where he was admitted in ICU.
Surgery was performed on him on December 4, 2020 but he is still unconscious.
The court was told that police are investigating an offence of attempted murder.
The magistrate said the nature of the offence being investigated may “tempt” Nthenya to flee and the fact that the crime scene is a public place, there was a likelihood that she may interfere with investigations.
Ndungi said there is a compelling reason to allow police more time as requested to enable them to complete investigation before making any decision in the matter.
He directed the case to be mentioned on December 14, for further orders.
