Witness recalls finding dying rally Khan lying on floor

A witness yesterday recounted how he called police officers after seeing rally driver Assad Khan lying in a pool of blood.

Samuel Kimani Kihanya told Justice Lilian Mutende when he saw Khan lying on the staircase to his house in a pool of blood, he decided to call police officers.

Kihanya, an estate manager, said when police officers arrived at the scene of crime, the accused, Maxine Wahome opened the door and upon entering the house, he saw bottles of alcohol and miraa on the table in the sitting room. He also noticed a pool of blood near the kitchen.

During cross-examination, Kihanya maintained that Khan was a violent person who had multiple girlfriends.

Assisted Assad

Asked why he decided to call the police instead of assisting Khan get medical aid, Kihanya said it was because he did not know the seriousness of the matter.

“I did not know that he was injured…and people who fight all the time, you leave it up to them,” he told the court. “There’s a time we were having drinks at his garage and he started being abusive to another lady,” the court was told.

In the case, Wahome, a former rally driver is been charged with Khan’s murder on December 12, 2022 at an apartment in Kileleshwa, Nairobi county.

Kihanya told the court that when police inquired about what had happened, Wahome said there was an altercation, forcing her to hide in the kitchen balcony. He added that Wahome further explained to the police that Khan suffered the injuries after he kicked the door to get to her.

During cross-examination, the witness told Wahome’s defence lawyers Philip Murgor and Steve Kimathi that Khan had previously unleashed violence on his other girlfriends. The defence lawyers played a video showing Wahome crying and explaining to the police that Khan was assaulting her.
