Why Governor Guyo’s legal team want impeachment case thrown out
By Kenneth Mwenda, July 8, 2025Isiolo Governor Abdi Guyo has asked the Senate to throw out the impeachment case against him, insisting that the documents provided by the County Assembly are flawed and inauthentic.
During a preliminary objection on Tuesday, July 8, 2025, Guyo’s legal team, Eric Theuri, Elisha Ongoya, and Elias Mutuma, challenged the Hansard used to support the June 26 vote to impeach the governor. They dismissed it as unreliable and not in compliance with legal requirements.
“The Hansard provided is not certified by the Clerk, which is a legal requirement,” Theuri argued before the Senate. “It contains inconsistencies that strongly indicate it was doctored. If the Senate finds that the proceedings were not valid, then this case should be dismissed entirely.”
The lawyers pointed out that the Hansard referenced a session supposedly held at 2:30 pm on June 26, 2024. However, official notices and invitations issued by the Speaker stated the meeting would begin at 9:00 am The discrepancy, they said, casts doubt on the legitimacy of the entire process.
“This impeachment is based on fiction,” Theuri said. “The Assembly documents were not generated through lawful processes, they were created outside the legislative framework.”

Procedural flaws undermine case
Mutuma also highlighted procedural gaps in the Hansard.
“The session begins abruptly without the Speaker calling the House to order,” he observed. “It jumps straight into the motion, which is a serious deviation from proper parliamentary procedure.”
In another objection, Ongoya told the Senate that the High Court had already annulled the impeachment motion after the governor challenged it in court.
“The judge found the motion and the so-called debate to be null and void,” Ongoya stated. “This Senate is now dealing with a motion that is already dead in the eyes of the law.”
Earlier that day, Governor Guyo denied all the allegations brought against him. He faces three charges: gross violation of the Constitution, gross misconduct, and abuse of office.
The allegations include failing to deliver the State of the County address for three consecutive years, irregular hiring beyond established staff limits, mishandling Ksh30 million in bursary funds, and making offensive and divisive remarks.
Guyo was impeached after 16 out of 18 MCAs voted against him. The Senate opted to hear the case in plenary over two days rather than through a special committee.
