US Embassy clarifies whether visa expiry determines length of stay

The U.S. Embassy in Nairobi has issued a critical clarification for travellers, emphasising that a visa’s expiration date does not determine how long a visitor can stay in the United States.

The announcement, posted on X on August 16, 2025, aims to guide Kenyan and regional visa holders on proper immigration procedures.

“A US visa allows you to travel to a US port of entry and request permission to enter. How long you are allowed to stay in the United States is not your visa’s expiration date. The CBP officer determines your ‘Admit Until Date’ upon arrival, and you can check the date online at i94.cbp.dhs.gov,” the embassy said.

Official record of stay

The embassy stressed that entry and stay duration are determined individually by U.S. Customs and Border Protection (CBP) officers at the port of entry. The ‘Admit Until Date’, recorded on the I-94 form, serves as the official authorisation of a traveller’s stay and can differ from the visa’s expiration date based on the officer’s discretion and purpose of visit.

“Having a visa is just the start—you must follow all immigration rules to keep your status valid. “Know the conditions of your visa,” the embassy advised, pointing travellers to travel.state.gov for more information. Compliance is critical to avoid overstaying or facing legal consequences.

Heightened visa scrutiny

The clarification follows the embassy’s July 25 warning requiring visa applicants to disclose social media handles from the past five years. Failure to provide accurate information on the DS-160 form can result in visa denial and permanent ineligibility.

These announcements reflect a broader trend of stringent US immigration controls. The embassy has repeatedly highlighted interagency efforts to combat fraud and illegal immigration, warning that those committing visa fraud risk lifetime bans. Transparency in applications, including social media disclosure, is seen as a key measure to prevent fraud while balancing security concerns.

As visa backlogs continue in the post-pandemic period, the embassy urges applicants to verify all details and ensure their digital and immigration records align with US. requirements.
