Tuju seeks orders blocking police presence at his hospital bed
By Zipporah Ngwatu, March 24, 2026Former Cabinet Secretary Raphael Tuju has filed a certificate of urgency at the Milimani High Court Criminal Division, seeking orders restraining the presence of police officers beside his hospital bed.
Tuju’s lawyers informed the Kibera Magistrate Court that he had been rushed to the Karen Hospital today for treatment after sustaining injuries while at the Karen Police Station.
The former Cabinet secretary was slated to plead to a charge of giving false information to a person employed in public service before Kibera Chief Magistrate Stellar Atambo on Tuesday, March 24, 2026.
In the application filed at the Milimani High Court, Tuju wants the Inspector General of Police (IG), the Directorate of Criminal Investigations (DCI) and the Directorate of Public Prosecution (DPP) to keep off his hospital bed.
“That this honourable court be pleased to issue an order directing the respondents (IG, DCI and DPP), their agents and servants to immediately cease and desist from maintaining any physical presence or guard over the first applicant (Tuju) at his hospital bed and allow him to receive medical treatment free from unlawful restraint, intimidation, or custodial interference,” part of the application reads.
Further, the former CS also wants the court to issue an order restraining the IG, DCI, DPP and all other officers subordinate to them from arbitrarily summoning, arresting, incarcerating, and interfering with his freedom of movement in relation to interactions with them.
Notably, he is also seeking to be admitted to anticipatory bail pending the hearing and determination of his application dated March 24, 2026.
“That in the interest of justice, the court be pleased to admit the 1st applicant (Tuju) to a reasonable bail term pending an ex parte hearing of this application or charge by the respondents (IG, DCI and DPP),” part of the application reads.
