Top cop in rape charge released on Sh0.5m bond

Former Kamukunji and Pangani OCS, Chief Inspector Samir Yunis, was yesterday charged in a Nairobi Court charged with using his position to sexually abuse his female junior colleagues.

Samir Yunus who appeared before Milimani Chief Magistrate Wendy Micheni pleaded not guilty to the charge of abuse of position of authority contrary to The Sexual Offences Act, 2006.

The prosecution alleges that on June 15, 2019 at Dandora police station in Nairobi county, Yunus being an Officer Commanding Station (OCS), took advantage of his position of authority and sexually abused  one JM within the limits of Dandora police station.

The magistrate ordered him to be released on a Sh500,000 bond with one surety of similar amount or a Sh200,000 cash bail pending pre-trial on December 20, 2022.

Section 24 (2) of the Sexual Offences Act states that any person who is a law enforcement officer and takes advantage of his or her position and has sexual intercourse or commits any other sexual offence within the limits of the station to which he or she is appointed, such person commits an offence of abuse of a position of authority and is liable upon conviction to imprisonment for a term of not less than ten years.

Yunus was arrested on Monday by detectives from the Internal Affairs Unit (IAU) after he honoured summons to appear before the unit’s director.

He was briefly detained at Capitol Hill Police Station where his fingerprints were taken and later released on a Sh10,000 cash bail.

It is said that the IAU launched investigations into Yunus’ conduct following several complaints by female officers who accused him of coercing them into sex.
