‘Right decision that gives nothing in substance’ – Kaluma dismisses court ruling declaring Azimio the majority party in National Assembly

Homa Bay Town Constituency Member of Parliament (MP) Peter Kaluma has dismissed a recent court ruling that declared the Azimio la Umoja One Kenya coalition as the majority party in the National Assembly, as a decision that gives nothing in substance.
Taking to his official X account on Sunday, February 9, 2025, the Orange Democratic Movement (ODM) lawmaker argued that the court declaration unduly delayed and denied the Azimio coalition allies justice.
According to Kaluma, several Azimio-allied political parties have since left the coalition living it for death.

He pointed out that the United Democratic Movement (UDM) left the Azimio coalition even before the parliament started its sittings, followed by Martha Karua’s Narc Kenya.
Kaluma further argues that the Democratic Action Party of Kenya (DAP-K) of Eugine Wamalwa and Kalonzo Musyoka’s Wiper Democratic Movement seem to have joined former Deputy President Rigathi Gachagua for a possible alliance ahead of 2027 elections.
He went ahead to note that the Jubilee party lost relevance soon after the 2022 general elections.
“UDM left Azimio before Parliament even sat. Narc Kenya left Azimio. DAP and Wiper left Azimio for a coalition with Gachagua. Jubilee died barely 5 months after the 2022 elections. Azimio died and was buried long ago. Court declaration that Azimio is the majority party in Parliament unduly delayed and denied us justice – it is no more than pyrrhic victory; a right decision that gives nothing in substance. Lawyers call this “judicialisation” of politics,” Kaluma stated.

Kalonzo calls Azimio PG
Kaluma’s remarks come a day after Kalonzo called for an Azimio Parliamentary Group meeting on Wednesday next week to make plans following Friday’s High Court decision that squashed a decision by Speaker of National Assembly Moses Wetang’ula declaring the Kenya Kwanza coalition the majority party in the House.
“I spoke to Raila Odinga and Uhuru Kenyatta. We want Azimio PG so that we can plan,” Kalonzo said.
Kalonzo who spoke during a funeral in Kitui expressed confidence that Kenya Kwanza will not appeal against the decision.
Court declaration
Milimani High Court on Friday, February 7, 2025, declared the Azimio coalition as the majority party in the National Assembly.
The judgement was delivered by a three-judge bench stating that Kenya Kwanza is not the majority party in the National Assembly.
Justices John Chigiti, Lawrence Mugambi, and Jairus Ngaah ruled on the matter.
According to the ruling, the majority party was determined by Kenyans during the August 2022 general elections.
“It is hereby declared that the question as to which party or coalition parties is the majority of the National Assembly of the 13th Parliament was determined by the sovereign will of the Kenyan voters during the August 9, 2022, general elections,” part of the ruling read.
