President losing cases over poor legal advice, says top lawyer
Jurist of the Year Award winner blames poor legal advice by the office of the Attorney for the loss of key cases by the President William Ruto Administration.
Public litigation lawyer Dudley Ochiel who won the 2023 Jurist of the Year Award advises the Kenya Kwanza administration to adhere to the Constitution in its bid to implement ambitious programmes it promised Kenyans.
Blocked his plans
“I believe President William Ruto needs better legal advice considering the number of court orders that have blocked his plans. He is likely to achieve a lot if he strictly follows the constitution,” said Ochiel in an interview with People Daily.
Ochiel support’s Law Society of Kenya concern over remarks by Ruto suggesting the use of the ceremonial sword to handle those opposing the Housing Levy through the courts, as aggressive and reckless.
Ochiel however condemned the president’s words stating that it is the right of Kenyans to challenge government actions through legal means. He pointed out that the courts had already ruled on the unconstitutionality of the Housing Levy, making it crucial for the President to respect the judicial process.
“The Courts have spoken about the unconstitutionality of the Housing Levy.
The President should therefore respect the ongoing Constitutional processes and refrain from issuing such veiled threats,” said Ochiel.
Ochiel pledged to continue using his voice, skills, and platforms to amplify the voices of the unheard, to advocate for the voiceless, and to fight for a Kenya where human rights, rule of law, and democracy prevail.
Ochiel who was recognised for his tremendous efforts in the advancement of constitutionalism, says the increasing number of court cases stopping president William Ruto’s plans should worry him.
