MP sues to block Ruto decree on future varsity
West Mugirango MP Stephen Mogaka has sued to challenge President William Ruto’s announcement that the proposed Nyamira University be established at Kiabonyoru High School.
The MP filed the case on Friday alongside his nominated counterpart Irene Mayaka, Nyamira Deputy Governor James Gesami and 44 other people from his constituency.
The respondents in the case include North Mugirango MP Joash Nyamoko, the Commission for University Education, the Ministry of Education and the Attorney General’s office.
’Powers usurped’
Mogaka’s lawyer, Danstan Omari, who filed the petition at the High Court in Nyamira, accused the President of usurping the powers of the Commission for University Education to establish universities.
The MP argued that If his application was not heard urgently and conservatory orders issued, the MP argued, Cabinet Secretary Ministry of Education and the national government would implement the President’s declaration.
“The implementation of the President’s declaration will be tantamount to sanitising the loss of Sh100 million of taxpayers’ [money] given that the people of Nyamira will lose out on the constituent college of [the] University of Eldoret,” Mogaka said in his affidavit.
