Pokot South MP David Pkosing has suffered a major setback after the High court declined his request to block the police from arresting him pending the hearing of his suit challenging his imminent prosecution over allegations of funding banditry. in West Pokot county.
A brief ruling delivered by Justice Daina Mochache on Tuesday, February 21, 2023, also declined the MP’s request to be granted anticipatory bail pending the inter-parties hearing of the suit on Thursday, February 23, 2023, at 3 pm.
The judge further directed Pkosing to serve the Directorate of Criminal Investigations (DCI), Inspector General of Police, National Police Service and the Director of Public Prosecution with his suit papers.
Pkosing who was arrested last week on suspicion of financing bandits in his court papers is challenging his prosecution claiming that the allegations are farfetched and baseless.
However, in a court application, the MP claims it is a witch hunt.
Pkosing has dismissed the claims through his lawyer, Danstan Omari, that he is being persecuted for bailing out seven men in a court case.
“I am being persecuted solely for offering to bail out seven young men from Kitale Law Court who were arraigned on 6/02/2023 in Kitale Misc Criminal Case No. E023 OF 2023,” court papers state.
According to Pkosing, he stepped in to help the seven because they are from Pokot South, which he represents in the National Assembly.
He wants the court to stay his arrest until his application is heard and determined
Pkosing claims that he has been summoned to DCI on Friday and is concerned that when he arrives, he will be arrested, similar to the famous ‘kamata kamata’ Friday arrests.
