Makadara court detains man charged with intimidation pending bail ruling
A Makadara Court has detained Ahmed Ali Mohammed, accused of threatening to kill another man, until Monday, 15, 2026, when it will rule on his bail and bond application.
The Directorate of Public Prosecution (DPP) has charged Mohammed with intimidation contrary to section 238 of the Penal Code.
According to the charge sheet, Ahmed, while at AS Petrol station in the Pumwani area within Kamukunji Sub-county, is said to have uttered the words, “Toa hio kesi kotini or I will kill you.”
The court papers reveal that the accused told the complainant to withdraw a case of obtaining by pretence that was pending before Makadara Law Courts, Court Two, Case No. E2910 of 2025.
The prosecution claims that the accused uttered those words on July 11, 2025, without any lawful justification, intending to instill fear or apprehension of harm in the complainant.
Appearing before Makadara Senior Principal Magistrate Gilbert Shikwe on Thursday, June 11, 2026, Ahmed denied the charge, and a plea of not guilty was entered.
The defence lawyers urged the court to grant their client reasonable bail and bond pending a hearing and determination of the case.
However, the prosecution told the court that they were opposing the application made by the defence to have the accused released on bail and bond, noting that his release would jeopardise the complainant’s safety.
“Your honour, this is a very serious offence, taking into consideration that despite being released on cash bail, the accused person has proceeded to intimidate the complainant to withdraw the pending case, whose threat jeopardises the safety of the complainant,” the prosecution submitted to the court.
“Your honour, the accused is in breach of the judicial bail and bond guidelines that direct that an accused person not interfere with witnesses in the pending criminal cases, and this now outweighs the accused person’s constitutional right to be released on bail and bond,” the prosecution added.
Magistrate Shikwe has directed the accused to remain in custody until Monday, June 11, 2026, when the court will rule on his application for bail and bond.
