Lenolkulal, co-accused to know the appeal court ruling

Former Samburu Governor Moses Lenolkulal and his co-accused Hesbon Jack Wachira Ndathi who were sentenced on Thursday may walk free this morning after the High Court granted them a Sh10 million bond each pending the hearing of their appeal.

This decision comes after both spent several days in custody following their conviction in a corruption case on Wednesday last week.

The bail ruling, delivered on Friday by Judge Diana Kavedza comes in the wake of their recent conviction and sentencing in a corruption case involving Sh83 million.

Lenolkulal and Ndathi were convicted on Wednesday last week after the court found them guilty of graft charges of conflict of interest and fraudulent acquisition of public funds from the Samburu county government in a tender for the supply of petroleum products

Following their conviction, which resulted in a hefty fine of Sh85 million for Lenolkulal and Sh83 million for Ndathi—or eight years in prison if they failed to pay the fines, the two appellants sought bail.

Their legal team, led by counsel Isaac Rene, filed a Chamber Summons on August 29, arguing that their appeal had strong prospects for success and thus merited consideration for bail. Judge Kavedza’s ruling considered several critical factors and deemed the application urgent.
