Karua questions court rulings, cites contradictions in Gachagua’s impeachment case

People’s Liberation Party (PLP) leader Martha Karua has raised concerns over contradictory and inconsistent court rulings in politically sensitive cases, claiming some judgements have failed to strictly adhere to the law.

Speaking during an interview with Milele FM on Friday, June 12, 2026, Karua argued that the inconsistencies are still evident in recent rulings, including cases involving the impeachment of Deputy President Rigathi Gachagua.

Karua’s past court case

Karua pointed to inconsistencies she said she has personally experienced in court processes, including her 2017 Nyeri gubernatorial petition.

She said evidence she had submitted in her case was allegedly disregarded at one stage, only for a higher court to later acknowledge its existence, creating what she described as contradictions in judicial findings.

Karua further narrated how the Court of Appeal and the Supreme Court handled her petition, noting that although some courts acknowledged procedural gaps and missing materials, the case was still ultimately dismissed.

She also cited a ruling by the East African Court of Justice, which she said emphasised that courts should focus on delivering justice rather than sympathy or technical interpretations that deny substantive justice.

Gachagua rejecting 50M

Gachagua has rejected the Ksh50 million in constitutional damages awarded to him by the High Court, saying the compensation does not address the constitutional issues raised in his impeachment case.

Speaking during a press conference on June 9, 2026, Gachagua criticised the court’s decision to uphold his impeachment while at the same time finding that his right to a fair hearing had been violated during the Senate proceedings.

“The Ksh50 million offered to me is an insult to my fundamental rights and freedom and a mockery of the constitution; we are not interested,” Gachagua said.

The three-judge bench upheld his removal from office but ruled that the Senate violated his constitutional rights after declining to adjourn proceedings despite his illness.

The judges subsequently awarded him Ksh50 million in damages for the violation.
