High Court accepts CS Duale’s apology, discharges him with a warning
By Zipporah Ngwatu, June 23, 2026The Milimani High Court has accepted the apology tendered by Health Cabinet Secretary Aden Duale over his contempt of court orders barring him and the government from establishing an Ebola facility.
In her ruling delivered on Tuesday, June 23, 2026, Justice Patricia Nyaundi issued a strict warning to Duale against repeating the same mistake.
Judge Nyaundi has stated that her decision to pardon Duale comes after noting that he has honoured the court summons and apologised for his actions and expressed his remorse, adding that she will give him the benefit of the doubt.
In discharging him, Justice Nyaundi has also noted that Duale has indeed submitted himself to the authorities of this court as he was required to, tendered his mitigation and rendered an apology to the court for disobeying the court orders.

“I have been invited to issue a warning; I will quantify that it is a strict warning and that any hint of non-compliance with the orders of the court will be noted. Since this is the first instance, the minister is responding to this,” Judge Nyaundi added.
“So, for that reason, I will accept the apology that has been sent, especially as he has been categorical that he recognises the authority of the court. On costs, I will not pay costs in this possible capacity, but in the same vein, at the same time,” Judge Nyaundi ruled.
Duale regrets actions
In his mitigation, Duale told the court that he regrets any actions he has taken over the establishment of an Ebola facility against the court orders that temporarily blocked him and the government from proceeding with establishing the facility.

In addition, he told the court that, as a public servant, a minister, and a citizen, he will be the last person to disregard that order and the last person to violate any constitutional order, even by any court.
“I sincerely regret any action, omission, misunderstanding, or misinterpretation that may have resulted in non-compliance with the order of this court or created the perception thereof,” Duale submitted to the court.
