A Nakuru court has found that a former Kapkures Ward representative has a case to answer in a forgery and fraud case involving a Sh30 million land.


Paul Kimutai and his aide Richard Kipngeno were yesterday put on defence by Senior Resident Magistrate Priscah Nyota six years after the case was filed in court.


“Evidence by prosecution witnesses, exhibits and testimony by experts linked the Mr Kimutai and Mr Kipngeno to forgery and fraud of the land located in Miti Mingi, Mbarut, within Nakuru County,” ruled Nyota.


Kimutai who served as a ward rep for Kapkures between 2017 and 2022 and his friend Kipngeno have been facing six counts of forgery, fraud, falsification of documents and giving false information to authorities.


Multimillion land


Evidence produced in court linked Kimutai to forging his deceased father’s signature with the intent to unlawfully transfer the multimillion land to himself and Kipngeno.


“Police investigations have concluded that Kimutai and Kipngeno forged title deed for the 6.6-hectare land, estimated to be worth Sh30 million. The prosecution has established a strong case against the accused persons and evidence shows that they have a case to answer. They are hereby put on defence,” Nyota ruled.


The two were arrested on July 12, 2017 and denied all charges levelled against them.


The first charge indicated that they forged the title deed and a green card on November 14, 2012.
“The accused persons purported that the green card had genuinely been registered by Harry Kipsuto, land registrar in Nakuru land office,” read the charge sheet.


The faced a second charge of fraudulently obtaining registration of the land in their names on September 14, 2022.


Kimutai further faced a charge of lying to the police that he was the owner of the land on April 11, 2017 at Nakuru Police Station under OB 42/11/4/2017. Kimutai and Kipngeno are accused if forging a family agreement on October 12,2010 which they used in the transfer.


According to documents produced in court, the land belonged to one Josiah Njoroge who purchased it at Sh2.8 million from Ingobor Farm Company Limited on April 17, 1997.
