Former KDF soldier sentenced to 10 years for incest

A former Kenya Defence Force soldier has been sentenced to serve ten years in jail for committing an indecent act against a minor.
Ali Hassan Sheikh who had served as a soldier was convicted by the Milimani Senior Principal Magistrate Zainabu Abdul after being found guilty of incest with his fourteen-year-old relative.
The former soldier faced two charges of incest and assault causing bodily to the minor.
The court heard that on diverse dates between May 2016 and May 2017 at Biafra estate in Shauri Moyo within Nairobi county, he engaged in sexual intercourse with the minor. The second count of assault was dismissed.
In mitigation through his lawyer Duncan Okatch, the accused person sought for a lenient sentence saying he was suffering from health complications.
“Your honour my client has a health challenge and I request this court to consider that condition on passing the sentence,” said Okatch.
The prosecution urged the court to consider the gravity of the offence and the fact that Sheikh was supposed to look after the minor.
Giving her sentence, the magistrate said she had considered the mitigation by the defence lawyer and the facts provided before the court. “I have considered the mitigation by the defence and the previous record of the accused that he has been a law-abiding citizen with no previous conviction but the matter is very serious,” said the magistrate.
