Executor of will says late Kibor was of sound mind

The executor of the late Uasin Gishu prominent politician-cum-farmer Jackson Kibor told the court yesterday that the deceased was mentally sound when he gave him instructions on how he wanted his multi-billion shilling assets to be distributed among his four widows and children.


Lawyer Bundotich Korir was giving his testimony before Justice Reuben Nyakundi during the hearing of a disputed will that was left behind by the late Kibor stating how his wealth should be shared among his family members.


The Will is at the centre of a court battle between the late tycoon’s 29 children and two widows who have rejected the document on grounds that it is a forgery by his fourth wife Eunita Kibor who has termed it as genuine.


Vast empire


Korir told the court that a few months before Kibor’s demise, he called him for a meeting at his Elgon View residential house on the outskirts of Eldoret town where he gave him instructions to draft his will detailing how his vast empire should be shared out among his dependents among them children he sired out of wedlock.


Korir dismissed claims by the objectors that the deceased was not of sound mind when he gave him the authority to draft his Will indicating the mode of distribution among his family members.


“To the best of my knowledge, the late Kibor was of sound mind at the time the Will was drafted and he could comprehend what he was doing in regards to distribution of his estate to his children who have now gone against his wish,” said Korir.


He further told the court that the deceased’s will was executed on February 27, 2021 at Eldoret High court’s parking yard and witnessed by two lawyers of choice namely, Joseph Kaptich and David Songok.
Justice Nyakundi adjourned hearing of the matter until Thursday.
