There was drama at the Makadara Law Courts in Nairobi when a woman alleged to have conned a businessman Sh640,000 failed to appear in court for plea taking.

Lucy Nyokabi Mathenge was expected to appear in court to face charges of obtaining Sh640,000 from John Ngaruiya by false pretences that she was in a position to sell to him a piece of land in Ruai, Nairobi county.

Her lawyer Gitonga Muriuki responded and pleaded with the court to defer the plea taking for seven days claiming his client was sick.

“Your honour my old client is not in this court today. I have directions that she is ailing,” Muriuki told the court.

But the complainant’s lawyer, Ms Achieng Otieno disputed Muriuki’s claims that the accused was indisposed, instead maintaining that she was hiding in a black Toyota Prado parked within the court’s premises.

She gave the court the registration number of the said motor vehicle which was at the parking area within the court premises.

Achieng claimed that Nyokabi was trying to evade justice by failing to appear in court to face the charges.

“Your honour the suspect is outside hiding in a vehicle and this is the second time,” said Achieng.

The lawyer further produced messages telling the court that Nyokabi had been trying to bribe the complainant not to take the matter to court but he declined.

The lawyer further told Makadara Senior Principal Magistrate Mary Njagi that Nyokabi has two other matters pending in Milimani Law Court where she absconded and a warrant of arrest issued against her. The court ordered the investigating officer in the matter to probe the authenticity of the medical reports which were produced in court
