The Director of Public Prosecutions Noordin Haji has approved the prosecution of Malindi Member of Parliament(MP) Aisha Jumwa and seven others over corruption.

Although MP Jumwa was investigated for the misappropriation of Sh57 million, the DPP said they were only able to establish a graft of Sh19 million.

In a statement, the DPP said the investigations done by the Directorate of Criminal Investigations (DCI) were sufficient to indict MP Jumwa over an irregular tender of Sh19 million by Malindi Constituency to a contractor.

“Accordingly, I direct that the above suspects be apprehended and arraigned in court to face the below listed charges under the Anti-Corruption and Economic Crimes Act No 3,” said the DCI.

The DPP held that Multserve Contractors Limited, the company mentioned as the beneficiary of the tender was irregularly earmarked for the construction of Malindi Sub-County Education Office.

After the award of the contract, the company(Multserve Contractors) illegally wired Sh2.5 million to MP Jumwa, the DPP said.

The MP concealed the proceeds by making an installment payment towards the purchase of a plot along Argwings Kodhek Road in Nairobi, held the DPP.

The others are Wachu Abdalla (NGCDF account manager), Kennedy Otieno, Bernard Kai, Margaret Kalume and Sophia Charo (NGCDF tender evaluation committee members), Multserve Contractors Ltd and Robert Katana (director of Multserve).

The suspects will be charged with;

  • Conspiracy to commit an offence of corruption
  • Wilful failure to comply with law related to Procurement
  • Conflict of interest
  • Money laundering
  • Acquisition of proceeds of Crime
  • Forgery
  • Uttering
