A Nairobi court yesterday summoned Officer Commanding Station (OCS) Nairobi area to appear in court on September 28 in a criminal case where three businessmen are charged with defrauding an Iranian national of Sh64 million in a fake gold deal.

The court wants the OCS to explain why he has not returned some of the personal items taken from the suspects in the case.

Milimani Chief Magistrate Susan Shitubi issued the summons after an investigating officer in the case failed to attend court to explain why he had not complied with an earlier court order requiring him to appear in court and explain why he has failed to return personal items  recovered during their arrest on April 17,2023 to the three accused persons among them two Kenyans namely Patrick Ngare Muchina and Kelvin Mwaura Ngotho and a Congolese national Muke wa Mansoni Didier.

“Your honour, the investigating officer is not cooperating with the defense, whenever we call him, he always says he is in a meeting,” said the defense. 

The three have denied charges of conspiracy to commit a felony and obtaining money by false pretences from Iranian businessman Sadegh Sadeghain Abolfazi. The case will be mentioned on September 28, 2023.
