A Milimani Anti-Corruption Court has summoned Kangema Law Courts Senior Principal Magistrate Martin Kinyua Mutegi to appear before it on July 30, 2026, for plea-taking.

The summons have been issued following a request by the Directorate of Public Prosecutions (DPP) after Magistrate Kinyua failed to appear in court for the plea-taking.

Kinyua’s counsel informed the court that his client, the magistrate, did not come to court for the plea-taking because he is unwell.

Chief Magistrate Harrison Barasa on Tuesday, July 28, 2026, granted the prosecution their request and ordered Magistrate Kinyua to appear before him on Thursday, July 30, 2026, for plea.

“In regard to the second accused person, the prosecution has sought the issuance of summons and the request is granted accordingly; summons shall be issued requiring the second accused, that is Martin Kinyua Mutegi, to appear before this court on July 30, 2026, at 9 am for plea and further directions,” Magistrate Kinyua ordered.

According to the charge sheet, Kinyua is supposed to be charged with receiving a bribe contrary to section 6(1)(a) as read with section 18(1) and (2) of the Anti-Bribery Act No.47 OF 2016.

The prosecution states that between July 16, 2026 and July 21, 2026, Kinyua, while at Kangema township within Murang’a County, requested a financial advantage of Ksh170,000 from one Peter Njihia Njuguna through a principal probation officer, Kandara Julius Irungu Njogu.

According to the charge, the said money was to enable the magistrate to pass a favourable sentence against Peter Njihia, who was facing criminal charges and had been convicted in the Kangema Chief Magistrate Court.

On the second count, Kinyua is supposed to be charged with receiving Ksh150,000 on July 21, 2026, from Peter Njihia through probation officer Kandara Julius Irungu for him to pass a favourable sentence against Njihia.
