Court remands four Chinese arrested over canning waiter

A Nairobi court yesterday ordered four Chinese nationals arrested over the alleged canning of a Kenyan waiter at their hotel, to be remanded in until Thursday when a ruling whether to allow police to detain them for 21 days, will be made.
This followed an application by Senior Assistant Director of Public Prosecutions Jacinta Nyamosi who sought 21 days to have the four suspects remanded to enable investigators to complete probe.
In her application Nyamosi told senior resident magistrate Hellen Okwani that on February 9, 2020 police arrested the four namely Deng Hailan, Ou Qiang, Yu Ling and Chan Yueping after a video appeared online allegedly of one of the suspects caning a waiter at the hotel.
The court heard that detectives from the Directorate of Criminal Investigations Kilimani raided Chez Wou Restaurant in Kileleshwa in Nairobi where Hailan had been captured in video caning a colleague for reporting to work late.
The court heard that the suspects were arrested following a report made at Kileleshwa police station by one Simon Osako Silo who happened to be an employee of the restaurant as waiter.
Nyamosi told the court that the complainant Silo reported that on February 2, 2020 was assaulted by Hailan after claiming that he had reported on duty late.
The court heard that after the incident, the complainant was dismissed at the work place by Hailan and was not paid his dues.
“It is notable that a video where the reportee was being assaulted went viral on social media which attracted the interest of the members of the public,” said Nyamosi.
“Investigating officer is yet to liaise with the relevant government institutions, namely Kenya Revenue Authority (KRA) to establish whether the respondents have been filing tax with the department,” Nyamosi said.
The prosecutor told court that investigating officer is yet to establish from the County Government of Nairobi if the respondents business is licenced.
She said the respondents being foreigners, are a flight risk and should not be released before the completion of the investigations. They are also likely to interfere with witnesses since some of them are employees at the restaurant.
