Court orders police to release MP’s cellphones after analysis

The court has ordered the release of cellphones of the six accused persons who were arrested alongside Embakasi East MP Babu Owino immediately after the conclusion of forensic analysis.

The court ruled on Friday last week that the seven accused persons appear in court today for the hearing of complaints filed by their lawyers.

The lawyers complained about the confiscation of their clients’ phones during their arrest last week on Monday.

They also complained about an alleged attack on one of the suspects, Calvina Gaucho by unknown people while in police custody at Kileleshwa police station.

Lawyer Duncan Okatch told the court Gaucho went to Kileleshwa police station to report the alleged assault but officers refused to record his statement. He requested the court to give directions on how the complainant will get justice.

Chief Magistrate Esther Kimilu ordered the police to release Babu Owino’s phone today while those of the co-accused be released immediately after the conclusion of the forensic analysis by investigating officer.

Kimilu also directed Gaucho to record a statement at any police station for his perpetrators to be charged.
