Court orders LSK to serveCS Linturi infertiliser case

The High Court has ordered the Law Society of Kenya (LSK) to serve Agriculture Cabinet Secretary Mithika Linturi (pictured)with its petition challenging the implementation of the National Fertiliser Subsidy Program (NFSP).

Justice Lawrence Mugambi said LSK has seven days to serve the petition on the CS, Agriculture Principal Secretary, National Cereals and Produce Board, Kenya Bureau of Standards, the Attorney General, KEL Chemicals Limited, the Director of Public Prosecutions (DPP) among other respondents.

Time to respond

The respondents will them be required to respond within fourteen days.

The Judge said he will issue further directions on the case on July 4.

LSK in its court papers says there is need to halt the continuation of the NFSP to allow room for public scrutiny into the progress of the program.

“The scrutiny will be in respect to the intricate scheme to defraud farmers through sale of fake fertiliser,” the documents state.

LSK argues that the programme was marred with fraud and the courts should intervene by restraining the Ministry of Agriculture from further implementing it until all farmers who allegedly fell victim to the substandard fertiliser are compensated and proper public participation for the implementation of the program is conducted.
