Court issues arrest warrant for Kware murders
A Nairobi court has issued a warrant of arrest against the Kware killings main suspect Collins Jumaisi. The court issued the arrest warrant even as it released the two other suspects in the case on a personal bond of Sh50,000 each.
Corporal Pascal Bwana attached to the DCI Headquarters Homicide Division Unit appeared before the Makadara Principal Magistrate Irene Gichobi for the mention of the matter.
The three suspects among them Jumaisi, Amos Momanyi and Moses Ogembo appeared in the same court ten days ago with the court granting the prosecution’s request to continue holding them for seven more days to allow for the conclusion of investigations.
When he appeared in court yesterday, Bwana confirmed to the magistrate that Jumaisi escaped from Gigiri Police Station on August 20, where he was being detained and is yet to be apprehended,
“Your honour I am confirming to this court that the first suspect in this matter Collins Jumaisi has escaped from police custody where he was detained and is yet to be arrested,” Bwana told the court.
He said they had forwarded the duplicate files to the Office of the Director of Public Prosecution for further directions.
Appear in court
He told the court that they received a response letter from the ODPP dated yesterday directing them to appear in court and pray that the two remaining suspects be released on bond.
“Your honour we have directions from the ODPP directing us that the two remaining suspects be released on bond,” he told the court.
The officer also told the magistrate that the two suspects may be turned into state witnesses whereas the first suspect who is at large will be charged with murder.
The ODPP further requested the court to give orders that the duo, Momanyi and Ogembo be reporting to the DCI Headquarters Homicide Division once every two weeks and the warrant of arrest against Jumaisi be issued.
Bwana further prayed that the matter be mentioned in a month’s time to give the investigating officers time to pursue Jumaisi and bring him to court.
Jumaisi’s lawyer John Maina Ndegwa who was in court said he will await the court’s directions.
“Your honour, I appear for the first suspect who is absent in court since I am still on record,” Ndegwa said.
Sichangi Nyongesa who is appearing for Momanyi and Ogembo welcomed the ODPP”s prayer that his clients be released on bond.
“Your honour I appreciate the decision by the prosecution that my clients be released on bond,” Nyongesa said.
He prayed for lenient bond terms for his clients saying that they had been in custody for more than a month and assured the court that he would ensure their appearance to the investigators whenever required.
The lawyer further pleaded with the court to give orders for the release of the 118 phones and other items recovered from Ogembo claiming they are not part of investigations.
However, the prosecution maintained that the said phones were still under analysis and prayed for two weeks to complete the task.
In his ruling, the magistrate took note of the ODPP’s request to release the two suspects on bond and the other prayers.
“I have noted the prayers sought by the prosecution to release the two suspects on bond and the issuance of warrant of arrest to the first suspect.
She released the two suspects on a personal bond of Sh50,000 with two contact persons each.
She further ordered them to report to the DCI Headquarters once in every two weeks.
The matter will be mentioned on September 26, 2024, for further directions.
