Court denies DCI access to footage

Director of Criminal Investigations (DCI) yesterday suffered a major blow after the court refused to grant instant orders for access to CCTV footage of former Interior Cabinet Secretary Fred Matiang’i’s Karen home in Nairobi during alleged police raid last week.
Milimani Magistrate Wandia Nyamu declined to issue the access orders and directed the DCI to serve the private security firm Bob Morgan Security Limited which installed and controls the CCTV cameras at Matiang’i home with the application. The case will be mentioned on March 7 for directions.
The move comes after last week the DCI was granted orders to access and retrieve footage for Karen Ngong view, where Matiang’i home is located.
The footage, in custody of Amsec security services Limited, covers events that occur in the area including the security barrier points.
Upon being granted the access of footage held by Amsec the detective realised that the same did not cover Matiang’i home compound.
Hence, the DCI yesterday morning decided to return to court with a fresh application for footage concerning the events of the home compound in possession of Bob Morgan Security Limited.
Unmask identity
In an application filed by the County DCI Headquarters Nairobi says that detectives want to unmask the identity of the persons behind the alleged raid following claims that they were police officers.
While seeking orders for access of the CCTV footage, the DCI told court that preliminary investigations so far conducted by its office have established that Matiang’i’s Nairobi residence is covered by Closed Circuit Television (CCTV) installed and controlled by a private security firm.
