Court bars six from selling, developing Goodrich land

Six people, including alleged owners of Anointed Academy, were yesterday restrained from selling or constructing any structures in a property where Goodrich School Ltd stands.

Commercial Court Senior Principal Magistrate Grace Ayuma Mmasi issued the temporary orders following a suit filed by Goodrich Schools, accusing the six of invading the property.

They are Josphat Murimi, Evans Murage, Joseph Njoroge, Julius Chale Mupio, Philip Mula Kimeu and Pastor Nimrod Mwangi.

The two schools, Anointed Academy and Goodrich are embroiled in a tussle over the parcel of land that borders Mukuru kwa Njenga and Imara Daima estates.

Goodrich school, was turned into a public school in December last year over claims it was formerly Mukuru Community Centre (MCC), a public primary and secondary school that admitted pupils from the area.

However, in the suit papers Goodrich argues that the defendants entered the suit and commenced construction based on the misguided authority of the Deputy County Commissioner, Embakasi and in total disregard of the court process.

Damage classrooms

Through lawyer Elkanah Mogaka, Goodrich says it has suffered damage to property and reputation as students are being withdrawn from the school on safety concerns.

“The petitioner is the purchaser of the parcel of land and the same is confirmed by way of a registered title,” stated Mogaka in court documents.

The school said, on December 21, thugs damaged classrooms, buses and a wall.

The school further accuses Embakasi Deputy County Commissioner of threatening to take over the property in which the school lies purporting it to be public land yet the school’s pupils are expected to report to school today.
