Blogger Ndiangui Kinyagia reveals fear for his life, asks for court protection
By Zipporah Ngwatu, July 24, 2025Blogger and IT expert Ndiangui Kinyagia has informed the court of his fears for his life, urging protection from being arrested.
Appearing before Justice Chacha Mwita on Thursday, July 24, 2025, Kinyagia told the court that he is terrified of what would happen to him in case the state agents arrest him.
He further urged the High Court to extend the orders that it had issued barring the police from arresting him.
“Your honour, I fear for my life, and I request the court to extend the orders barring my arrest by the police,” Kinyagia pleaded with the court.
Additionally, the blogger informed the court that he was ready to testify while also asking to be granted more time to go through the court documents touching his case.
Meanwhile, in a turn of events, Senior Counsel Martha Karua and the Law Society of Kenya (LSK) sought to withdraw from representing Kinyagia in his case.
Lawyer Karua told the court that her decision comes following conflicting instructions and the need for transparency.
Notably, she told the court that an affidavit to cease acting had already been served to the family’s lawyer, Kibe Mungai.
On July 18, 2025, lawyer Kibe, who was representing Lilian and the family, informed the court that he had originally joined forces with both the LSK and Kinyagia after making contact with the family.
He told the court that he had been tasked with liaising with the family and Kinyagia and assisting in preparing the affidavit.
However, he told the court that after further discussions, the family amended the affidavit without his involvement, resulting in discrepancies between his original instructions and the final document filed in court.
“When we left court, the family said the affidavit was making them uncomfortable, and I told them to amend it to a version they were comfortable with; subsequently, I received an amended affidavit that was materially different from the instructions I had drawn from Ndiang’ui,” lawyer Kibe told the court.
In the previous court proceedings, the LSK President Faith Odhiambo told court that Kinyagia’s account of how he disappeared contradicts a statement given by his cousin Lilian Gitonga.
The cousin, Lilian, had stated that Ndiang’ui called from an unknown location to say he was safe and well.
Justice Mwita extended the no-arrest orders until further notice and also directed Kinyagia to file an affidavit and appoint a lawyer of his choice within 14 days.
Kinyagia and his cousin Lilian Wanjiku Gitonga are expected to testify and be cross-examined on September 16, 2025, at 10:30am.
