Arrest warrant issued for businessmen in Ksh150M Westland land case
By Zipporah Ngwatu, April 17, 2026The court has issued a warrant of arrest against two businessmen, Abdisalan Adan Hussein and John Kigomo Mwaura, linked to a conspiracy to defraud two ladies of a maisonette in Westlands, Nairobi, valued at Ksh150 million.
According to the charge sheet, the two are alleged to have conspired to defraud Sabahatt Shokatali Habib and Sadaff Shokatali Habib on April 29, 2019, of the said maisonette by falsely registering a lease document of the said parcel of land.
The two businessmen were scheduled to plead to charges against them on Thursday, April 16, 2026, after the court had summoned them for the plea taking, but they did not show up in court for the plea.
Milimani Principal Magistrate Geoffrey Onsarigo directed the two to appear in court today, Friday, April 17, 2026, for plea taking, and they still did not come to court.
Magistrate Onsarigo has now issued warrant of arrest orders against the two, Adan Hussein and Kigomo Mwaura, for failing to come to court despite summons to appear and plead to charges lodged against them.

“I hereby issue a warrant against Adan Hussein and Kigomo Mwaura for failing to appear in court for plea taking as earlier ordered,” Magistrate Onsarigo ordered.
Admitted to hospital
Appearing before Magistrate Onsarigo, Lawyer Joseph Mutava, representing businessman Adan, informed the court that his client has failed to appear in court; he has been admitted to a hospital.
The court heard that Adan was taken ill when he got to Garissa while he was on his way from Wajir to Nairobi to honour the court summons issued.
“Your honour, my client is not in court because he is admitted to a hospital in Garissa after he felt ill while travelling to Nairobi yesterday to attend court today,” lawyer Mutava told the court.
However, when the court asked lawyer Mulwa to provide the court with the hospital documents and the name of the hospital he is admitted to, he said he did not have the details.
“Your honour, he just sent me a WhatsApp message saying he is admitted to a hospital in Garissa,” lawyer Mutava told the court.
He requested the court to grant his client two weeks to recuperate before appearing in for the plea taking.
His request was vehemently opposed by the prosecution and lawyer Paul Macharia, representing the two women, who argued that there were no medical records produced in court to confirm, indeed, the businessman is admitted.
The prosecutor added that the accused persons had disobeyed two court summonses to attend court and plead to 16 criminal charges against them.
Magistrate Onsarigo declined to defer the plea taking for two weeks as requested by lawyer Mutava for his client and issued the warrant of arrest against the two, ordering they be produced in court on April 27, 2026.
