2 charged for raping their friend’s girlfriend in turns

Issa Odhiambo Suleiman and Ndaya Kassim Owino were arrested after they allegedly raped their friend’s girlfriend when she blacked out.

The two were on Friday, January 20, 2023, arraigned before Senior Resident Magistrate Mercy Malingu at the Makadara Law Courts having been charged with sexual assault contrary to section 10 of the Sexual Offences Act (SOA) of 2006.

According to the charge sheet, Owino and Odhiambo raped their friend’s girlfriend in turns on the night of January 15, 2023.

According to the victim, who reported the incident at Buruburu Police Station, she met Owino at a local pub in Nairobi’s Umoja estate while drinking with her boyfriend.

Later, the victim, her boyfriend and Owino left together with the intention of spending the night at Owino’s house.

However, along the way, they were joined by Odhiambo who persuaded them to go to his house which was nearby.

The four continued drinking and chewing miraa in Odhiambo’s house. They, however, ran out of beer and started arguing over where to get alcohol and who was to buy it. During the argument, the victim’s boyfriend left the three inside Odhiambo’s house.

Owino reportedly gave the victim a beer he was drinking and she immediately blacked out. The woman woke up the next day at around midday and found herself on Odhiambo’s bed alone.

Odhiambo asked her to leave because he wanted to go to work and she left. She did not notice that anything had happened to her at that moment.

Upon getting to her house, the woman started experiencing pain and she notified her boyfriend about it, informing him that she suspected that she was raped by Owino and Odhiambo.

The victim said Odhiambo and Owino admitted to raping her in turns while she had blacked out when she met them the following day.

She sought treatment in the hospital before reporting the matter at Buruburu Police Station. Detectives conducted investigations before arresting Owino and Odhiambo who were then charged with sexual assault.

The two suspects denied the charges when they were arraigned in Makadara Law Courts. They claimed the victim only lodged a complaint against them because her boyfriend had learnt of the incident.

Court released the duo on a Ksh500,000 bond without an option of cash bail.

The case will be mentioned on February 15, 2023, before the hearing starts on April 5, 2023.
