Malala explains Gachagua’s choice to remain in office despite witnessing rot in government

Democracy for Citizens Party (DCP) Deputy Party Leader Cleophas Malala has defended their party leader, and former Deputy President Rigathi Gachagua, revealing why he chose not to resign despite witnessing alleged misconduct within President William Ruto’s administration.

In an interview on Thursday, August 21, 2025, Malala emphasised that Gachagua was elected by the people and not appointed by President Ruto. He pointed out that Gachagua’s impeachment did not originate from the public but was initiated by the government.

“Gachagua was elected by the people, not appointed by President Ruto. Gachagua’s impeachment did not emanate from the public; it came from Ruto’s government.”

Gachagua’s impeachment

Gachagua was impeached by the Senate in October 2024 on charges including corruption, insubordination, and inciting ethnic violence.

Gachagua denied all accusations, labelling the impeachment as a politically motivated attack.

In response, Gachagua filed a petition in the High Court seeking to halt the impeachment process.

He argued that the proceedings were unconstitutional and politically orchestrated.

However, the court declined to block the Senate’s vote, stating that the matter was within the legislature’s domain. Subsequently, Gachagua challenged the decision, leading to a series of legal battles.

Adding to the controversy, Gachagua questioned the legitimacy of the judicial process, particularly the formation of a three-judge bench without the direct authorisation of Chief Justice Martha Koome. His legal team argued that this was a breach of constitutional procedures.

Despite the legal challenges, the Senate upheld his impeachment, and Kithure Kindiki was sworn in as the new Deputy President. This transition marked a significant shift in Kenya’s political landscape.

Since his dramatic ouster, Gachagua has refused to retreat from the political scene. Instead, he has intensified his criticism of Ruto, accusing him of betraying the people he serves and of engaging in impunity.
