Governance expert Kevin Osido proposes urgent revision of MPs’ recall clause

Governance expert Kevin Osido has called for an urgent review of the clause to recall underperforming Members of Parliament (MPs) and Senators.

Speaking to a local radio station on Friday, November 7, 2025, Osido revealed that MPs are currently in charge of their own fate as far as recalling them goes, hence making the provision ineffective.

According to Osido, the recent happenings have proved that a majority of leaders have failed the test of principles of progressive leadership and are only there to serve their own selfish interests.

“We have given power to the legislative houses but muzzled the citizens’ space to take back over this power. The provision in Article 104 of the Constitution no longer works, and recalling MPs has been made very difficult,” he disclosed.

Osido has emphasised that the recall should extend to the constitution to enable citizens to offer more checks on people vested with power.

“The same legislature has to legislate on its recall. We have to push for a review of the recall clause so that we can recall MPs who look only for their stomachs,” he stated.

“Beyond the campaign financing, we have to bring in the recall clause of the constitution so that checks and balances can be exercised for people tasked with the responsibility of legislating,” he added.

His remarks come amid a raging debate on the state of Kenyan parliamentarians and their work as the representatives of the people.

DCP party leader, Rigathi Gachagua, recently called on voters to prioritise academic professionals over experienced politicians.

Speaking to a packed audience, Gachagua lauded Raila for building ODM into a strong political party capable of influencing successive governments despite never being elected president.

Gachagua named prominent ODM members such as Governor James Orengo, the late Otieno Kajwang, Edwin Sifuna, Tom Ojienda, Otiendo Amollo, Caroli Omondi, Millie Odhiambo, Peter Kaluma, Stewart Madzayo, Babu Owino, and Mohammed Faki, noting that they had protected Raila for 30 years.

He also called on lawyers and other professionals from Mt. Kenya to vie for elective posts, appealing for 140 MPs under the DCP party, including at least 40 legal minds, to safeguard the interests of citizens.

Gachagua warned that the absence of principled, educated leaders allows corruption and poor governance to thrive, urging the elite to step forward.
