Garissa County resident wants election of Senator Mohamed Haji nullified
A resident of Garissa County has moved to court to have the election of Abdulkadir Mohamed Haji as Garissa Senator nullified citing numerous electoral malpractices.
Ahmed Rashid Koriyow Abdi claims the election of Senator Abdulkadir Haji to succeed his late father Yusuf Haji was neither free nor fair.
Besides, electorates were not given fair opportunity to elect the senators of their choice.
“Garissa County electorates were neither consulted nor allowed to participate in free and fair elections before appointment to office as Abdulkadir Haji,” the petitions reads in part.
Abdi, who was eyeing the seat on Narc Kenya tickets has trained his guns on politicians who he alleges of misusing their political influence and intimidating him to withdraw from the race through immense verbal abuse and physical harassment.
He has listed Senator Abdulkadir Haji, Garissa Township MP Aden Duale and his Ijara counterpart Sophia Abdi has respondents.
“I wish to state that the respondents have violated my inalienable constitutional right to inherent dignity and the right to have that dignity respected and protected and my freedom from discrimination,” it reads in part.
The petitioner is also appointing an accusing finger at village elders and religious leaders who were involved in overdrive gear in coercing him to surrender and withdraw from the contest.
The Independent Boundaries and Electoral commission (IEBC) and Martha Karua’s led party Narc Kenya are listed as interested parties.
“Aden Duale and Sophia Abdi called me and conducted a series of meeting to intimidate and coerced me to withdraw from the by-elections,” it says.
It adds: I wish to state that they acted in total breach of the procedure, statute, the constitution, sound order, and expended valuable resources in the unlawful appointment of the senator.
The petitioner claims that the trio and their agents intimidated all rival candidates to withdraw from vying for the seat to have Abdikadir declared unopposed.
“They plotted to dismiss all rival contestants including myself from applying for the said position,”
In a petition, filed at the constitutional court review on Friday, Abdi has also trained his guns on the Independent Boundaries and Electoral commission (IEBC) for occasioning gross breach of constitution by unlawfully appointed Abdulkadir devoid of due electoral process.
