Miwani Sugar alleges State agency’s role in attempted land grab

The battle between Miwani Sugar Company Ltd and an alleged private developer over 3,000 acres of land has intensified with some government officials being fingered for hatching a secret plot to take over the land.

The  miller is now accusing the individuals of fraudulently attempting to acquire the piece of land through an alleged private investor called Crossely Holdings Ltd.  

Miwani Company Sugar Ltd through its lawyer David Otieno is warning of a well choreographed fraudulent scheme by officials at the National Lands Commission to acquire 3,000 acres of Miwani Company Sugar Ltd land through a private developer, yet its already a State property.

“By the time they were bidding for a public auction they already had consent from Nyando Lands Control Board. 

“This is a party which had consent from the Nyando Lands Board, three weeks before the sale of the property from the Nyando Lands Control Board, “ he said. Otieno said there is already a gazette notice dated February 25, 2022 issued by the National Lands Commission chairman Gershom Otachi, seeking to controversially purchase 3,000 acres of the vast 10,000 acres Miwani Company Sugar Ltd from Crossely Holdings to be used for the Kisumu Special Economic Zone.  

According to lawyer the court did not give any order of eviction to any auctioneer and there is no single warrant issued by the court to compel anyone to take money from Miwani Company Sugar Limited.  

Official complaint

The sugar company has since lodged an official complaint to the National Police Service following an attack by goons that left one person dead and property damaged.  

In addition, the company through its attorney has written to the Registrar of Court of Appeal seeking the Appellate court to fast-track hearing of the case as it is of huge public interest.  

It has also emerged that the purported auctioneer who brought in the over 50 goons in Miwani on Wednesday had no binding court order to execute the forceful eviction.
