Kitui Governor Charity Ngilu’s legal team was dramatically ejected from the County Assembly precincts yesterday, where they had gone to answer impeachment summons against her.

 Trouble started when the lawyers led by Martin Oloo and Morris Kimuli showed up reportedly to answer to summons requiring their client to appear before the assembly for her impeachment debate, slated for yesterday.

 According to Oloo, they were allowed into the assembly grounds where they sought the assembly clerk’s audience, but the orderlies pounced on them and threw them out.

Ejection orders

 “Although the court issued orders stopping the ouster debate, the cerk never cancelled the summons to the governor, forcing us to appear on her behalf this morning,” explained Oloo.

He lamented that assembly legal counsel Gladys Kanyaa had instructedorderlies to eject them on the pretext that they had no right to appear before the assembly.

The MCAs last weekend indefinitely put off debate on Ngilu’s removal from office pending determination of a court case on July 6.

 Oloo said it was wrong to manhandle an advocate in the course of duty and vowed they would lodge a complaint with the Law Society of Kenya (LSK).

Conduct investigations

Meanwhile, the LSK has written a protest letter to the Inspector General of Police Hillary Mutyambai and Director of Criminal Investigations George Kinoti to conduct thorough investigations into the incident.

“We find the harassment of our members in full glare of police officers extremely retrogressive, besides being an affront to the State obligation towards ensuring free and unhindered access to justice,” said LSK President Nelson Havi.

He also urged lawyers to desist from being their own enemies.

“Lawyers working in various sectors are enemies of each other. There is need to have a unity of purpose because we do not work for our own course but on our client need,” he said.
