Gachagua ouster case

A three-judge bench will rule today, Wednesday, October 23, 2024, at 3.30 pm, whether they will withdraw from a case challenging orders blocking the appointment of Kithure Kindiki as the deputy president.

Justices Eric Ogola, Anthony Mrima, and Freda Mugambi set the date after the parties extensively submitted information on how they were appointed to hear the case.

Impeached Deputy President Rigathi Gachagua through his team of advocates led by Senior Counsel Paul Muite argued that the only person who can empanel a bench is the chief justice.

They sought to find out at what point the file came from Kerugoya at 4 pm Saturday for Deputy Chief Justice Philomena Mwilu to appoint Justices Anthony Mrima, Eric Ogola and Fredah Mugambi to hear the matter.

In daylong submissions, Gachagua’s lawyers spiritedly pushed for the disqualification of the judges, saying he was not satisfied with the manner in which the bench was appointed.

The case challenging orders blocking the appointment of Kindiki was filed by Solicitor General Shadrack Mose.

Mose seeks to set aside the orders blocking Kindiki’s swearing-in to succeed Gachagua as the Deputy President.

In his application, Mose argues the order is against the country’s interest to delay Kindiki’s swearing-in as the constitution does not envisage a vacancy in the office of the Deputy President.

“The said conservatory orders were issued ex-parte and without according to the state or the National Assembly or the parties a chance to be heard,” the application reads.

Graft suspects in court

George Mwazighe Mwandembo, former head of public procurement officer at NSSF, and 3 others will today, Wednesday, October 23, 2024, be in court for the hearing of a corruption case in which they are involved.

They are charged with conflict of interest and fraudulent procurement practices.

Allegations relate to holding a private interest by the first accused in a tender for supplying and installing bulk filers worth Ksh47.8 million awarded by the NSSF to Beldavo Enterprises.

The case will be heard at Milimani Anti-Corruption Court.

Another graft case that will be up for hearing today at Milimani Law Courts involves Robert Theuri Murage and Doris Nafula Simiyu, a suit for recovery of Ksh39.2 million embezzled and irregularly paid from the National Treasury into the accounts of the defendants in the guise of allowances for official duties.
