Court drops former PS graft case for lack of evidence

A Nairobi Anti-Corruption Court yesterday allowed the State Prosecutor’s request to withdraw a corruption case against former Youth and Gender PS Lillian Omollo over the loss of Sh167 million at National Youth Service (NYS) for lack of evidence. 

In a brief ruling, Chief Magistrate Lucas Onyina allowed the Office of Director of Public Prosecutions (DPP)’s request to drop charges of abuse of office and conspiracy to commit an economic crime against Omollo. 

“Upon evaluation of the request by the prosecution and since the same is not opposed by Omollo, l therefore, allow the withdrawal of the charges under Section 87 (a) of the criminal Procedure Code (CPC),” Onyina ordered.

The magistrate, however, directed the case against Omollo’s co-accused persons, former NYS Director-General Richard Ndubai, the five members of Ngirita’s family and several former government officials to proceed to its logical conclusion.

This is after the DPP, through state prosecutor Mercy Gateru only sought to drop charges against Omollo saying none of the witnesses who have testified in the case so far has implicated her directly or indirectly with the scandal.

Omollo and Ndubai were accused of conspiracy to commit an economic crime by allowing the payment of Sh167,715,700 to three companies including Firstling Limited, Kunjiwa Enterprises and Ameritrade Limited.
