Sacked council boss in court to challenge his acrimonious ouster
Employment and Labour Relations Court yesterday certified as urgent a suit challenging the Council of Legal Education’s decision to sack chief executive Emmanuel Wambua (pictured).
Justice Linnet Ndolo, however, ordered Wambua to serve the Council of Legal Education (CLE) with pleadings before the hearing of the case on December 19.
Directions by the court came after Wambua sued the council over its decision to revoke his appointment as CEO.
On November 29, the Council, through a notice signed by its chairman Githu Muigai, resolved not to confirm Wambua for the position of secretary and CEO at the council, effective December 1.
Aggrieved by the decision, Wambua last week petitioned the Labour Court challenging the decision to terminate him from the said position on grounds that the failure of confirmation was a result of a flawed Performance Appraisal System marred with discrimination and cherry picking of the applicable laws and procedures
“The Contract of Service contained discriminatory clauses which subjected Wambua to specialised terms not applicable to his employment stature by virtue of the council’s ’s own Human Resource Policy and Procedures manual,” Wambua says in court papers.
Wambua wants the court to suspend process of implementing the council’s decision and stop the process of recruiting for a new chief executive.
