Why suspects in ex-Kabete MP murder case want judge disqualified

Four suspects linked to the heinous murder of former Kabete MP George Muchai’s and his three aides have  asked the trial judge to disqualify himself for being biased.

Raphael Kimani alias  Kim Butcher, Kimani Anyonyi alias Musti, Stephen Lipapo alias Chokore and Erick Muyera alias Chairman urged Justice James Wakiaga to recuse himself from the case as they have lost confidence in him.

“We are not satisfied with this court. We have lost confidence in it and we want the judge to disqualify itself for being biased,” said the suspects.

This is after the suspects who are remanded at Kamiti Maximum prison had failed to appear one week ago for the further hearing of the case in protest of the same.

Their co-accused said they have no problem with the trial Judge and want the case to proceed without further delay. They are Jane Kamau, Margaret Wachuiri.

Justice Wakiaga directed the suspects and any other party to file a formal application raising their reasons as to why they want him out of the case within seven days before the hearing on November 13.

The suspects accused of murdering Muchai, his driver Stephen Wambugu and bodyguards Samuel Kalikia and Samuel Matanta on February 6, 2015 on Kenyatta Avenue, Nairobi County.

The application prompted the case which had been scheduled for two continuous weeks to stall.

So far, three witnesses out of 41 have testified.

All the accused persons have been in custody since March 2015 when they were charged with four counts of murder.

The hearing will resume on November 13.
