Saboti MP Caleb Amisi has urged the state to obey court orders barring Deputy President-elect Kithure Kindiki from assuming office pending the determination of a petition on October 24, 2024.

In a statement, Amisi stated that Kindiki would still assume the office after the conclusion of the court process following the approval of his nomination by the National Assembly and subsequent gazettement of the same by the speaker of the National Assembly on October 18, 2024.

“To be safe, just obey the court order. The country needs sobriety. He will still go home anyway, so send him the right way,” Amisi said.

Court orders

The courts have called for a pause on the process after High Court Judge Justice Chacha Mwita referred a petition to Chief Justice Martha Koome to consider constituting an uneven number of judges to determine the case.

In his ruling on Friday, October 18, 2024, Justice Mwita noted that some of the issues raised were significant and demanded the attention of more than one judge.

“In the meantime, due to the issues raised in the petition and application, and the urgency demonstrated, a conservatory order is hereby issued staying implementation of the resolution by the Senate upholding the impeachment charges against the petitioner, the Deputy President of Kenya, including the appointment of his replacement,” Justice Mwita said.

“That due to the significance of the issues raised in the petition and application, I certify this matter as raising substantial questions of law and public interest and, therefore, fit to be heard by a bench of an uneven number of judges appointed by the Hon. Chief Justice. The file be placed before the Hon. Chief Justice immediately for consideration in that regard,” Chacha further ruled.

Amisi skipped the Friday session where 236 MPs voted in support of President William Ruto’s nominee for deputy president Kithure Kindiki who currently serves as the Cabinet Secretary for Interior and National Administration.

While all the members present at the National Assembly voted in favour of Kindiki to succeed the embattled former Deputy President who was admitted at the Karen Hospital with severe chest pains on Thursday, October 17, 2024, more than 90 leaders skipped the session.
