Walingo rejects inclusion of secret recording

The hearing of the Sh177 million corruption case against Maasai Mara University Vice Chancellor Mary Walingo (pictured) and four others was adjourned yesterday after the defence team objected to an attempt by the prosecution to play a recording allegedly indicting the five in the case.
Walingo’s lawyer Hosea Manwa while objecting the admission of the evidence in court, said that the recordings obtained by the prosecution team should not be admissible since it was obtained illegally.
This came up after key prosecution witness Spencer Sankale took to the stand for the second day, informing the court he was able to record the accused persons through visual and audio format which he wanted admitted to the court records.
Sankale in his testimony yesterday informed the court that he made at least thirteen recordings on phone through the call recorder and eleven from the watch which he wanted played in court and be admitted as evidence.
Prosecution wanted to produce the recordings however, it was vehemently opposed by the defence team on grounds that the conversation was private and that the recordings did not have certificates to authenticate them.
“We cannot allow the court to admit this evidence since the prosecution side need to prove they have fully complied with section 106 of the evidence act before we can move forward, the evidence was obtained illegally without consent,” said Manwa.
