‘Speaker acted in contempt of court’ – Babu Owino on Kenya Kwanza majority ruling

Embakasi East Member of Parliament (MP) Babu Owino has weighed in on National Assembly Speaker Moses Wetang’ula’s declaration on the majority in parliament.
Speaking during an interview with a local TV station on Wednesday, February 12, 2025, Babu noted that it is not the work of the National Assembly Speaker to determine and state the majority, but to interpret the court’s ruling. He added that Wetang’ula’s proclamation on the matter is contempt of court.
Babu went on to state that Wetang’ula was also a culprit as his dual roles as Speaker and Ford Kenya Party leader were declared unconstitutional by the court,
With the twist of events, Babu has now urged the Azimio la Umoja – One Kenya Coalition to cut ties with the government.
“The courts said that the majority party is Azimio. It is not the work of the Speaker of the National Assembly to determine and state that Kenya Kwanza is the majority coalition but to interpret the judgment that was issued in court. Therefore, the Speaker has acted in contempt of court and that court decision was mentioning the Speaker adversely that he was a culprit in it due to the fact that he is a speaker and a party leader, it is a complete conflict of interest. I advise the Azimio coalition to leave this broad-based government as it is now the bed-based Parliament,” Babu said.

Wetang’ula’s verdict
Wetang’ula’s ruling on the court matter has sparked debate across the political sphere with various leaders calling for his impeachment.
In his ruling, Wetang’ula declared that the Kenya Kwanza Coalition remained the majority side in the National Assembly.
The Speaker justified his verdict stating that the High Court ruling did not designate which side was the Majority and the Minority but only annulled his earlier declaration.

He also explained that he was not informed by Azimio nor Kenya Kwanza on the changes in house leadership.
“I have not received any further communication from Kenya Kwanza Coalition replacing the Member of Parliament for Kikuyu, the member for Kilifi, the member for South Mugirango and the Member for Marsabit County as their preferred leadership in the house.
“Similarly, I have not received communication from Azimio One Kenya Coalition party replacing the Suna East MP, the Kathiani MP, Suba North MP and Member for Embakasi West as preferred leadership in the house,” Wetang’ula stated.
“Consequently the leadership of the house remains unchanged.”
