Samburu Governor Moses Lenolkulal on Thursday got a reprieve after trial court dismissed case by Director of public Prosecutions (DPP) seeking to cancel his bail.
The DPP had argued that the decision by Lenolkulal to reshuffle his CECs was a Breach of his bail terms.
Senior Principal Magistrate Thomas Nzioka ruled that he was not convinced that there was interference of witnesses when he reshuffled his CECs.
However, Assistant DPP Alexander Muteti said they will appeal the decision at the High Court as soon as possible before the trial begins on February 11.
Lenolkulal lawyer Paul Nyamodi says the ruling was based in law and they welcome it but leaves the issues of appeal to court to make decision.
Magistrate Nzioka says the proceedings will be typed on priority basis by noon on Thursday to enable the prosecution file their appeal
