National Police Service issues fresh guidelines on public gatherings

The National Police Service (NPS) has issued a reminder on the legal framework governing public gatherings, citing constitutional provisions and statutory requirements that regulate the right to assemble in Kenya.

The NPS reiterated its mandate under Article 243 of the Constitution, with functions outlined in Article 244, in a statement released on April 24, 2026.

“Article 244(c) requires the Service to comply with constitutional standards of human rights and fundamental freedoms,” while affirming respect for citizens’ rights under Article 37, which guarantees the right, peaceably and unarmed, to assemble, to picket, and to present petitions to public authorities.

The statement further referenced Article 24 of the Constitution, which allows for limitation of rights and fundamental freedoms where such limitations are reasonable and justifiable in an open and democratic society, particularly for the protection of public order, public safety, and the rights of others.

Public Order Act requirements and compliance

The NPS also outlined requirements under the Public Order Act Cap. 56(5), which regulates public meetings and processions.

These include holding events between 6:00 a.m. and 6:00 p.m., issuing notice to the regulating officer at least three days but not more than fourteen days before the event, and providing full names and physical addresses of organisers.

The Act also requires organisers to indicate the proposed date, venue, or route of the event and maintain responsibility for participants’ conduct.

“The organiser of a public meeting or procession remains accountable for the conduct of their members and must fully cooperate with law enforcement officers at all times.”

The Service warned that failure to comply with these requirements may result in disruptions or enforcement measures aimed at maintaining public order and safety. It urged organisers to observe all legal provisions when planning gatherings.

Public guidance and policing framework

The NPS called on members of the public to exercise their rights within the established legal framework. “NPS wishes to remind and advise the public to exercise their rights within the law and in a manner that maintains peace, security, and respect for our constitution,” the statement read.

The advisory comes at a time of increased public civic engagement and political activity across the country. The NPS noted its continued role in ensuring lawful conduct during public events while maintaining order and protecting lives and property.
