Maribe, Jowie to know fate in murder case on October 6

The judgment in a case where businessman Jowie Irungu and journalist Jacque Maribe are accused of killing businesswoman Monica Kimani in September 2018 will be delivered on October 6.

High Court judge, Lady Justice Grace Nzioka, set the judgment after the defence and prosecution completed their final submissions.

Maribe and Jowie, through their lawyers, asked the court to acquit them saying the prosecution had failed to prove beyond reasonable doubt that they killed Monica who was found brutally murdered at her home in Lamuria Gardens.

Maribe’s lawyer, Katwa Kigen, argued that none of the witnesses had incriminated the former news anchor in the murder.“The case is based on circumstantial evidence; there’s no direct evidence against the second accused person,” Maribe’s lawyer said.

Kigen likewise told the court that Maribe was not aware of Monica’s existence. He further state that there was also no DNA evidence linking Maribe to Monica’s murder.

“There was no blood group association between the blood that was found and the accused and there’s no confession that would suggest that she had a hand in the death of Monica,” Kigen argued.

“There’s no telephone data to demonstrate that she communicated with the deceased, Maribe has given timings of where she was and the people she was with when Monica’s murder allegedly occurred.

The prosecution has confirmed both the location and times so where is the entry point then?” he posed.
Prosecution said that DNA test results placed Jowie in Monica’s house despite him denying knowing her.
It argues that Maribe needs to be convicted alongside Jowie because she never gave any alibi evidence.
